These Terms of Service ("Terms") govern your use of the watersafety-australia.com website and any services provided by Coastal Water Safety Australia Pty Ltd (ABN 94 696 775 256) ("CWSA", "we", "us", "our"). By using this website or engaging us to provide services, you agree to these Terms. If you do not agree, please do not use this website or engage our services.
1. Who we are
Coastal Water Safety Australia Pty Ltd is an Australian proprietary company headquartered in Port Macquarie, New South Wales. We provide professional water safety services including drone shark surveillance, event water safety, and search and rescue, primarily across NSW.
2. Use of this website
This website is provided for general information about our services. You may use the website for lawful, personal and business purposes only. You must not:
- Use the website in a way that breaches any applicable law;
- Attempt to disrupt, damage, or gain unauthorised access to the website or its underlying systems;
- Reproduce, copy, sell, resell or otherwise exploit any part of the website without our written permission;
- Use any automated means to extract or harvest content from the website except as expressly permitted by our robots.txt file.
3. Intellectual property
All content on this website — including text, photography, drone footage, logos, the CWSA wordmark, the slogan "Pushing limits. Protecting lives.", graphics, design and arrangement — is owned by Coastal Water Safety Australia Pty Ltd or used under licence, and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute or modify any of it without our prior written consent. Brief, attributed quotations for legitimate news or review purposes are permitted under fair dealing.
4. Service engagements and quotes
Information published on this website (including service descriptions, areas served and indicative pricing) is general and does not constitute a binding offer. A binding agreement to provide services is formed only when we provide a written quote or service agreement and you accept it in writing (including by email).
Each engagement is governed by the specific terms set out in your written quote or service agreement. Where those terms are silent, these Terms will apply by default.
5. Bookings, deposits and payment
Unless your written quote states otherwise:
- A non-refundable deposit may be required to confirm a booking;
- Final payment is due within 14 days of invoice date;
- Late payment may attract interest at the Reserve Bank of Australia cash rate plus 4% per annum, compounded daily;
- We may suspend or terminate further work if any invoice remains unpaid more than 30 days past its due date.
6. Cancellation and weather
Water safety operations are weather and surf dependent. We reserve the right to cancel, postpone or modify a deployment if conditions present an unreasonable risk to our crews, equipment or your participants. Where we cancel due to safety considerations, fees paid for the cancelled deployment will be refunded or credited, less any non-recoverable costs already incurred (such as travel or specialised equipment hire).
If you cancel a confirmed booking less than 14 days before the scheduled date, the deposit is non-refundable and additional cancellation fees may apply as set out in your quote.
7. Insurance
We hold current public liability insurance and operate under approved aviation authorisations for our drone activities. A certificate of currency is available on request to event organisers and councils engaging us.
8. Safety, regulations and compliance
Our services are delivered in accordance with applicable Australian laws and regulations, including but not limited to Civil Aviation Safety Authority (CASA) drone operating rules, NSW Maritime regulations, and applicable workplace health and safety laws. Where you engage us as part of an event you operate, you remain responsible for the overall safety management plan and for ensuring all other parties (including participants, contractors and venue operators) understand and comply with that plan.
9. Liability and consumer guarantees
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded or restricted.
Where we are permitted by law to limit our liability, our total aggregate liability to you in connection with the website or any services we provide is limited, at our option, to: (a) re-supplying the services; or (b) refunding the fees paid by you for the specific services that gave rise to the liability.
To the extent permitted by law, we are not liable for any indirect, consequential, special or incidental loss, including loss of profit, loss of revenue, loss of opportunity, or loss of reputation.
10. Indemnity
You agree to indemnify us against any loss, damage, claim, cost or expense (including reasonable legal fees) we suffer or incur as a result of: your breach of these Terms; your negligent or wrongful act or omission; or any inaccurate or incomplete information you provide to us about an event, location or participants.
11. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
12. Third-party links
This website may contain links to third-party websites. We do not control, endorse or take responsibility for the content, accuracy, privacy practices or availability of any third-party site.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be at watersafety-australia.com/legal/terms.html, and the "Last updated" date at the top of the page will reflect any changes. Material changes that affect a specific engagement will be communicated to you in writing where possible.
14. Governing law
These Terms are governed by the laws of the State of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
